By purchasing online, or in person, as a player, or parent of a minor (18 years and younger), I understand that I will be held to a standard of conduct during these Nerf Battles. Failure to abide by safety rules will result in a warning or expulsion from the game without refund. I also understand that I may decline to participate in any part of the game at any time. I also understand that if I refuse to play, it does not constitute grounds for refund. By signing this waiver, I understand that I will be voluntarily engaging in an activity that may involve contact and the risk of serious injury, permanent disability, or death, and may cause severe social or economic losses due to not only my/other players actions or interactions. Further, I agree that I will not damage any equipment of Arena51 nor the facility that they partner with. I agree to pay for any and all expenses that might relate to the participants care and treatment. In exchange for participation in Nerf battles (the “Activity), organized by: Arena51 located at a partnering facility, I herby agree as follows: I and anyone claiming on my behalf release and forever discharge Arena51 and its affiliates successors and assigns, officers, employees, representatives, partners, agents, volunteers, and anyone claiming through them (collectively, the released Parties”) in their individual and/or corporate capacities from causes of action of any nature and kind, known or unknown, which I may have against Arena51 or any Released Parties arising out of or relating to any injury, loss or damage to person and property that may be sustained as a result of participation in an Activity (“Claims”). I understand that participation in the Activity involves inherent risks, including risk of physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent paralysis, and/or death, and I assume all related risks and voluntarily participate in the Activity. Pictures and videos may be taken by anybody during any event. I consent to have my picture/video taken by anybody. I agree to indemnify Arena51 against any and all claims, actions, lawsuits, damages and judgments, including attorney’s fees, arising out of or relating to my participation in the Activity. This Release for Participation in Event or Activity (“Release”) shall not be in any way construed as an admission by Arena51 that it has acted wrongfully with respect to me or any other person, that it admits liability or responsibility at any time for any purpose, or that I have any rights whatsoever against Arena51. This Release shall be binding upon the parties and their respective heirs, administrators, personal representatives, executors, successors and assigns. I have the authority to release the Claims and have not assigned or transferred any Claims to any other party. The provisions of this Release are severable. If any provision is held to be invalid or unenforceable, it shall not affect the validity or enforceability of any other provision. This Release constitutes the entire agreement between the Parties and supersedes any prior oral or written agreements or understandings between the parties concerning the subject matter of this Release. This Release may not be altered, amended or modified, except by a written document signed by both parties. The terms of this Release shall be governed by and construed in accordance with the laws of the State of Oklahoma. I have carefully read and fully understand all the provisions of this Release and am freely, knowingly and voluntarily entering in this Release. Arena51 Rules 1. ALWAYS keep your safety glasses on while in the gym! 2. ALWAYS keep your blaster on safety when off the playing field! 3. No firing when you are out of the game, when there is no game in session, or outside of the playing field! 4. No blasters outside of the gym! 5. Point your blaster towards the ground for extra safety! 6. No modified blasters allowed! 7. Do not tip over, jump on, kick, or punch bunkers! 8. No arguing, fighting, or cursing. Remember that it’s just a game! 9. Spectators must stay in the Spectator Zone! 10. Remember to empty all blasters when your session is over! 11. Must have Extreme Fun at Arena51 12. Failure to follow rules will follow these steps in order: a. Warning will be given to correct action. b. Will be taken off the field for one game for safety education. c. Will be disqualified from the field with no refund.
